1. Our trade policy

    1. The seller offers the products for sale in www.adrianaiglesias.com exclusively to end-users who are “consumers”, and only in relation to them develops their e-commerce activities.
    2. When we speak of “consumer” we mean any natural or legal person who acts within www.adrianaiglesias.com for purposes other than those that are specific to the commercial, business or professional activities that may develop. If you are not a “consumer”, we invite you to refrain from conducting business transactions on www.adrianaiglesias.com.
    3. Every client must be at least over 18 years old.
    4. Taking into account its own commercial policy, the seller reserves the right not to attend to orders made by subjects that differ from the “consumer” or, in any case, to orders not in conformity with the aforementioned commercial policy.
    5. The Site is dedicated to retail and, as such, is intended for the exclusive use of consumers.  Subjects other than Consumers are invited not to place purchase orders. In the event that one or more sales are made to an unqualified Consumer, these Conditions shall apply, notwithstanding the provisions thereof:
      1. The buyer shall not be granted the right of withdrawal in accordance with Article 6;
      2. The purchaser may not benefit from the guarantee of the Products referred to in Article 3;
      3. The purchaser shall not be granted other protections, provided here in favour of the Consumer, which reflect or comply with the mandatory legal provisions;
      4. The contract of sale concluded between the Seller and the buyer shall be governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods – 1980 Vienna Convention.
    6. These General Conditions of Sale exclusively regulate the offer, the acceptance of purchase orders and the shipment of products of www.adrianaiglesias.com between the users of www.adrianaiglesias.com and the seller.
    7. The General Conditions of Sale do not, on the contrary, regulate the supply of services or the sale of products by subjects other than the seller that are present in www.adrianaiglesias.com by means of links, banners or other hyperlinks. We advise you to review your conditions of sale before placing orders with subjects other than the seller or purchase their products and services, since the seller is not responsible for the provision of services by third parties other than the seller or for the conclusion of e-commerce transactions between users of www.adrianaiglesias.com and third parties.

2. How to contract with the seller

    1. To conclude the contract for the purchase of one or more products of www.adrianaiglesias.com you will have to fill in the order form that the seller puts at your disposal in electronic format and transmit it to the seller by telematic shipping, following the instructions specified for that purpose.
    2. The order form contains a summary of the General Conditions of Sale, as well as numerous information about the essential characteristics of each product ordered, its respective price with details of taxes and other applicable costs, the payment methods that you can use to buy each product, the delivery methods of the products purchased, the shipping and delivery costs, the date on which the Seller undertakes to deliver the/the products/s, the legal guarantee that can be applied to the products, the conditions for exercising your right of withdrawal and the arrangements and time limits for returning the products purchased.
    3. The contract shall be deemed to have been concluded at the time when the seller receives your order form by telematic sending, but this is subject to verification of the accuracy of the data relating to your order.
    4. Before proceeding to the purchase of the products through the transmission of the order form you will be asked to read carefully and accept the General Conditions of Sale, the Privacy Policy and the article dedicated to the Right of Withdrawal, that you print a copy and that you archive or reproduce another copy for your personal use.
    5. The order form will be stored in our data bank for a period of time essential for the correct delivery of your orders, and always within the limits established by current legislation. You can access your order form by consulting the My Order section.
    6. Before sending the order form, you will be asked to detect and correct any errors in the entry of the data.
    7. The language you will have to conclude the contract with the seller is Spanish.
    8. After the conclusion of the contract, the seller will take care of your purchase order.
    9. The seller may refrain from processing orders that are found to be incomplete or incorrect, or in case the products are not available. On these occasions we will inform you by email that the contract is not concluded and that the seller has not given continuity to your order, properly specifying the reasons for this.
      In case the products presented in www.adrianaiglesias.com are no longer available or for sale at the time of your last access to the website, that is, at the time of sending your order form, the seller will inform you as quickly as possible about the availability of the products you have ordered.
      If you have already sent the order form and paid the price of your order, the seller will refund the amount you have advanced without delay.
    10. By means of the telematic transmission of the order form you unconditionally accept these General Conditions of Sale and the Privacy Policy and you agree to observe them during your relations with the Seller. If you do not agree with any of the terms cited in the General Conditions of Sale, we invite you not to send us the order form for the purchase of the products on www.adrianaiglesias.com.
    11. By sending us the order form you confirm that you know and accept the General Conditions of Sale and the rest of the information contained in www.adrianaiglesias.com (up to those parts accessed through links, including the General Conditions of Use and the Privacy Policy).
    12. After the conclusion of the contract, the seller will send you by e-mail and within 24 (24) hours after the conclusion of the contract, a receipt of the purchase order containing a summary of the information presented in the order form (the General Conditions of Sale, the data relating to the essential characteristics of the product and detailed information about the price, the payment methods, your right of withdrawal and the shipping costs, the date on which the Seller undertakes to deliver the/products/s, and the legal warranty that may apply to the products).

       

 3. Guarantees and information on product prices

    1. In www.adrianaiglesias.com only Adriana Iglesias brand products are offered for sale.
    2. The seller does not sell used, defective or substandard products.
    3. The essential characteristics of the products are presented in www.adrianaiglesias.com within each product fiche. Despite the scrupulous care taken by the seller in its faithful reproduction, the images and colors of the products offered for sale on www.adrianaiglesias.com may, however, do not faithfully reflect reality due to the specific characteristics of the Internet browser or screen used by the user.
    4. Product prices may be subject to updates. Make sure what the final selling price is before submitting the respective order form.
    5. Purchase requests from Countries not included in the list present in www.adrianaiglesias.com cannot be accepted by the seller (to know the exceptions read the article Shipments).
    6. All products are fitted with an identifier label fastened with a disposable seal. Please do not remove the label or its seal from the products, as they are an essential part of the product itself 
    7. In the event that you exercise your right of withdrawal, the seller has the right not to accept the return of the products without their respective label, as well as products which have been damaged or whose essential and qualitative characteristics have been altered.
    8. All products sold by the Seller are covered by a warranty of twenty-four (24) months for lack of conformity, as provided by applicable law. You must inform the Seller of the existence of such lack of conformity within a period of two (2) months from the day you detected the lack of conformity. Please contact our Customer Service. In case of lack of conformity, you can choose between repair or replacement of the product. If such remedies are impossible or disproportionate, you are entitled to require the Seller to make an appropriate price reduction or to terminate the contract.
    9. If during the procedure of selection of the Products on the Site, the Customer considers that the price of one or more of the Products he intends to select for subsequent purchase is clearly lower than the price normally applied, net of any discount and/or promotions in force at that time, due to an obvious technical problem that occurred on the Site, please do not complete the purchase order and inform the Seller’s Customer Service of such technical error, by sending an email to the email address admin@adrianaiglesias.com

       

 4. Forms of payment

    1. To make the payment of the price of the products and the respective shipping and delivery costs you can adopt one of the modalities indicated in the order form.
    2. Purchases made on www.adrianaiglesias.com. Can be paid by credit card, bank transfer and PayPal
    3. Orders that include products in Preorder can only be paid by credit card or bank transfer
    4. Every purchase is made with maximum security thanks to the use of the most advanced technological systems in the field of e-commerce and with encryption systems (SSL) to protect your personal data and credit card information from unauthorized access.
    5. The credit card details are sent, during the execution of the order, to Banco Santander and are protected against unauthorized access through the encrypted transfer of SSL data (‘Secure Socket Layer’). Such data are not accessible to third parties.
    6. Once the order is completed, you will receive a confirmation email with your order number and a detailed summary of your purchase. Remember that you can check the status of your order at any time in the relevant section of your profile
    7. In case you make the payment by credit card, the bank details (for example, the credit or debit card number or its expiration date) will be transmitted via a cryptographic protocol to Banco Santander or other banks, responsible for providing the respective remote electronic payment services, without any third party being able to access them. Such data, moreover, will never be used by the seller except in order to complete the procedures related to your purchase, issue the corresponding refunds in the event of any refunds arising from your right of withdrawal and prevent and inform the police forces in the event of any fraud committed or about to be committed in www.adrianaiglesias.com.
      The amount of the purchase of the products and the shipping costs, as indicated in the order form, will be debited to your current account or credit or debit card at the time of shipment of the purchased products

       

5. Time limits and arrangements for reimbursement

 

    1. Whatever form of payment you have used (credit/debit card, PayPal or payment by bank transfer), the refund will be activated by the seller as soon as possible and, in any case, before fourteen (14) days from the date on which the seller became aware of the exercise of your right of withdrawal, but only after having verified the correct exercise of your right and having accepted the return of the products.
    2. Where the consignee of the products indicated on the order form and the person paying the sums corresponding to their purchase are not the same person, the reimbursement of the sums caused by the exercise of the right of withdrawal shall be effected by the seller in relation to the person who made the payment.
    3. For credit or debit card purchases, the date of payment of the refund will be the same as that of the debit, so you will not suffer any loss in terms of bank interest.
    4. The seller designates DHL as the carrier for return shipments of the goods (www.dhl.com). If you decide to use the DHL courier service, the refund fee (the amount of which will match the amount of the shipping costs) will be deducted from the refund corresponding to the amount you paid for your purchase. You can return the products to the seller via DHL by downloading the return label. According to the modalities and terms contained in the article dedicated to the right of withdrawal, this method allows the seller to manage the transport of the returned products. This mode also allows you to check at any time where each package is, freeing you from any liability in case of loss and damage to the products during transport.
    5. In the event that you decide to use the services of a carrier other than the one designated by the seller to return the goods, you must make yourself the payment of the return costs, and you will receive the refund for the full amount you paid for your purchase. In such case, you will assume all responsibility for any possible loss or damage to the products returned during the transport, according to the modalities and the terms described in the article dedicated to the Right of Withdrawal.

7.  Applicable law

    1. The General Conditions of Sale and the contract are subject to Spanish legislation, and in particular to Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary legislation.

      It is also reported that the European Commission provides a platform for alternative and extra-judicial dispute resolution. It can be accessed at http://ec.europa.eu/odr

 8. Modification and updating

    1. The General Conditions of Sale are amended from time to time and taking into account any changes in the legislation and regulations in force. Each new version of the General Conditions of Sale will be effective from the date of its publication in www.adrianaiglesias.com.

 

PRE ORDER POLICY

Adriana Iglesias, offers the option of pre-order in our latest news, usually this option takes two to four weeks. Simply pay a 50% deposit at the time of purchase, then your previous order is confirmed.

You will be notified when your order is ready to be shipped and payment of the remaining balance is due. Payment will be automatically charged in full. Once confirmed, your order will be sent directly to you.

Size and fit details will be recommended and listed on the product page. You can click on “Size Chart” on each Adriana Iglesias product page for help with size conversion. As sizes vary, please contact Customer Service for any additional questions with your size and fit, if necessary at customercare@adrianaiglesias.com.

 

Payment of a Pre Order 

When you decide to purchase from our pre-order, you are initially charged a deposit of 50% of the total price of the item(s) in the box. Once you receive email confirmation that your pre-order piece is ready to ship, our system will automatically charge the remaining balance within 24 hours.

 

Canceling Your Pre Order Purchase

The order cannot be cancelled unless the shipment has been inevitably delayed beyond the estimated delivery window. Any other request for cancellation is at the discretion of Adriana Iglesias, and can only be refunded as site credit.

 

Brand Initiated Cancellations

Sometimes, Adriana Iglesias may have to cancel certain styles after thepre-    order has ended, due to production reasons. If your order/item(s) has been cancelled, you will be notified immediately and the full amount of the deposit will be refunded to the original payment method used to make the pre-order. Refunds must be reflected in your return within ten (10) business days

1. Shipping and delivery of products 

The Seller undertakes to do everything in its power to comply with the delivery times indicated on the Site and, in any case, to make the delivery within a maximum period of 30 (thirty) days from the day following the order has been forwarded by the Consumer. In the event of the Seller not executing the order, due to the lack of availability, even temporary, of the Product, the Seller will provide a written notice to the Consumer and will refund the amount already paid by the Consumer 

Delivery times may be delayed for public holidays; transporters do not deliver on 25/12, 26/12, 01/01

If the Consumer has chosen the bank transfer as the payment method, the delivery time shall start from the receipt of the consideration by the Seller.

The shipment of the Products ordered by the Consumer will be made in the mode selected by the Consumer, among those available and indicated on the Site at the time of sending the order. The Consumer undertakes to verify as soon as possible that the delivery includes all the Products purchased and promptly inform the Seller of any defect in the Products received or of their discrepancy with the order made, in accordance with the procedure set out in these Conditions, the Products shall be deemed to be accepted in the absence thereof. If the parcel or packaging of the Products ordered by the Consumer reaches a clearly damaged destination, the Consumer is invited to refuse delivery by the carrier/freight forwarder or to accept delivery “with reservation”.

For credit card orders, in normal shipping times, it is necessary to add a business day for normal administrative checks. For orders placed by bank transfer, shipping times will be calculated from the confirmation of payment.

For orders containing products in advance order, shipping times will be calculated from the receipt of the email confirming the availability relative to the last pre-order product that has been available in chronological order.

Due to regulations applied by national authorities to contain the spread of Covid-19, standard delivery times may suffer some inconvenience.

INTERNATIONAL SHIPMENTS
Shipping times and costs will depend on the chosen delivery address and will be displayed at checkout.

All additional costs, charges, taxes and/or duties payable in any given country, under whatever title, to the Products ordered under these Conditions are the exclusive responsibility of the Consumer.

SHIPMENTS TO SPAIN
Shipping within Spain is free and delivery times will go from 4 to 6 working days for regular orders, pre-order orders are excluded

 

2. Return policy

In accordance with Article 102 of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users (the «Spanish Consumer Code»), you have the right to terminate the sales contract with ADRIANA IGLESIAS ATELIER SL. (the «Seller») , for any reason and without incurring any penalty within fourteen (14) days from the date you received the goods purchased on www.adrianaiglesias.com.
You may exercise your right of return by the following means, in accordance with Article 106 of the Spanish Consumer Code:

Online delivery to the Seller of the return form located in the Customer Service area, duly completed. In this case, the Seller will send you an email confirming that you have received your return request.

According to Article 108 of the Spanish Consumer Code, once you have exercised your right to terminate the sales contract, you must deliver the returned products to the courier service within fourteen (14) days after notifying the Seller of its decision to terminate the contract.
It will not be possible to change the chosen article to another.
In accordance with Article 103 of the Spanish Consumer Code, the right to terminate the sales contract is excluded if you have purchased customized or personalised products, or sealed articles which have been opened after delivery and cannot be returned for sanitary or hygienic reasons. 

    1. Conditions for the exercise of the right of withdrawal in accordance with Article 102 of the Spanish Consumer Code.

       

      The right to terminate the sales contract shall be deemed to have been properly exercised once the following conditions have been fully fulfilled:
      1. The right of withdrawal has been correctly exercised within fourteen (14) days from receipt of the products following the procedures set out above.
      2. Products may not have been used, dressed or washed, and must comply with the requirements shown in the Compliance Checks section below.
      3. The identification label with the disposable seal remains attached to the product as it forms an integral part of the product (see Article 5 below).
      4. The products are returned with their original packaging.
      5. The products are delivered to the courier service within fourteen (14) days from the date on which it notifies the Seller of its decision to terminate the sales contract.
      6. The products are not damaged.

If the relevant conditions have been met, the Seller, in accordance with Article 107 of the Spanish Consumer Code, shall refund in full the price of the products purchased. The only costs that will be charged to you are
those of the return of the products, unless the Seller has expressly exempted you from such costs when making your purchase, provided that you use the courier service and the shipping method indicated below in paragraph 2. In the event that returned products cannot be accepted due to non-compliance with the conditions indicated in points a) and e) of paragraph 1 above, or in Article 103 of the Spanish Consumer Code, you may choose, on your own behalf, to have the products returned to you. If you refuse such delivery, the Seller reserves the right to retain the products and the amount paid for the purchase of the same. 

    1. Procedure for returning products to the Seller – DHL

The Seller recommends that you use the DHL courier service (www.dhl.com) to return the products. 

If you use the DHL services and the return label, which contains the return address, you will not have to pay the refund fees in advance. The Seller will pay the DHL courier service on your behalf and deduct from your refund an amount equivalent to the cost incurred for the delivery of products purchased in your home. Please contact DHL to arrange a return. The ability to track each package shipped at any time by making use of this shipping method exempts you from any liability for the loss or damage of the products during transportation. If you decide to return the goods using a courier service other than DHL, you will have to pay the shipping costs of the return in advance and will be liable for any loss or damage to the goods during transport. In this case, you will also be reimbursed an amount equivalent to the standard shipping cost of the products purchased although, in accordance with Article 107, paragraph 2, of the Spanish Consumer Code, You will not be refunded any additional costs you incur for choosing a different or faster shipping and delivery method than the standard method.

    1. Verification of compliance

Our products must be returned new and unused, in perfect condition, with all protective materials in place and labels and stickers attached (if applicable), including all accessories and documents. We reserve the right not to accept a return if the product shows signs of wear, has been used or has altered its original condition in any way. Alternatively, you may decrease the applicable refund or change accordingly.
For example, we may apply a reduction in the following cases:

      • The product has been used, dressed, damaged or washed.
      • The identification label with the disposable plastic thread has been removed or not returned. Please note that the identification label is an integral part of the product.
      • The packaging, which is an integral part of the product (such as the storage bag), has not been returned.

We will let you know if we decide to reduce your refund for this reason. In that case, you can (as an alternative to being assigned a lower refund) choose to resend the products, taking care of the expenses. If you reject this delivery, ADRIANA IGLESIAS reserves the right to retain the products and the indicated amount of refund reduction, due to the reduction of the value of the returned products. 

    1. Time limits and reimbursement procedures

Once the Seller has received the returned products and verified compliance with all requirements, you will receive an email confirming that the return has been accepted. ADRIANA IGLESIAS will then proceed to make the full refund or, if the products have decreased in value, you will receive an email informing you of the amount deducted from the refund and ADRIANA IGLESIAS will proceed to make the refund of the remaining amount. Regardless of the form of payment used, the Seller will proceed to the refund as soon as possible and, in any case, within fourteen (14) days from the date on which he was informed of his decision to exercise the right of refund, and once you have verified that the return was carried out in accordance with the above conditions.
The deadline for reimbursement of the amount paid for the purchase of the returned products depends on the payment method used:

      • Credit/Debit Card Purchase: The repayment deadline will depend on the card entity, but will normally take place over two billing cycles. The value date for the credit shall be the same as the value date of the initial debit. Therefore, it will not suffer any loss in terms of bank interest.
      • Payment by PayPal: the refund will be paid into your PayPal account and will be visible immediately. The actual refund on the credit card associated with your PayPal account will depend on the company that issued the card.
      • Payment by bank transfer: the refund will be made in the bank account used at the time of purchase, so the repayment time will depend on the accuracy of the data you provide us. The repayment period is normally fourteen (14) days.
    1. Items returned as damaged, defective or incorrect

If you return a product due to an error on our part or because it is damaged or defective, you must notify the Seller within seven (7) days of receipt of the product using the online return form available on the website. If a product becomes defective after seven (7) days, please contact Customer Service for more information about returns. You must return the products in the same state you received them. For the return of the products, please refer to paragraphs 1 and 2 above.
Seller will examine all returned products as damaged or defective and will notify you of your refund by email within a reasonable time. Subject to the limits set out in the Spanish Consumer Code, products returned as damaged or defective will be refunded in full, including the cost of shipping the item and the cost you incur when returning the item to the Seller. You can purchase separately a new product of the same model of the returned product if you wish and if available.
In the event that the returned products do not meet the requirements to be legally qualified as damaged, defective or incorrect; or the requirements to claim a refund or change thereof, according to the provisions of the Spanish Consumer Code, you will be notified that the returned products cannot be accepted and you can choose to have the products delivered to you again. If you do not accept the return, the Seller reserves the right to retain the products and the purchase price, as well as to recover the expenses and costs incurred for their return (including shipping costs, return costs and depreciation of the product).

    1. Identification label

We remind you that all products sold by the Seller include an affixed identification label that is an integral part of the product. Try the products without removing the label or seal. Products returned without the label or seal will not be accepted.

    1. Spanish Consumer Code

The present conditions for exercising the right to terminate the sales contract form an integral part of the Terms and Conditions of Sale and are governed by Spanish law and, in particular, by the Spanish Consumer Code.
